Retamco Operators, Inc. (ROI) sued Paradigm Oil, Inc., Pacific Operators, Inc., and Pacific Operators of Texas (collectively "Paradigm"), alleging breach of contract and fraud arising out of an oil and gas lease. In this appeal, appellant Paradigm seeks relief from "death penalty" sanctions and a post-answer default judgment entered against it by the trial court. Paradigm presents four issues for appeal: (1) whether the trial court abused its discretion in granting the default judgment; (2) whether the trial courts damage award is supported by evidence in the record; (3) whether the evidence presented in a prior hearing is legally and factually sufficient to support the trial courts award of actual and exemplary damages; and (4) whether the trial courts severance order should be reversed if the case is remanded on liability or damages.
